The type O classification
1 What type O covers
Type O covers hotels, guesthouses and collective accommodation establishments with sleeping accommodation for the public. What distinguishes the type is precisely the presence of sleeping accommodation: it is that characteristic which triggers the reinforced requirements, whatever the occupancy.

For type O the reference occupancy takes in the number of people accommodated overnight plus the staff simultaneously present. A hotel of 80 double rooms can exceed 160 guests, to which the night staff must be added.
3 The particular hotel articles
The hotel articles of the regulation carry requirements specific to hotels. Notably, and exceptionally within the regulation, they include provisions applicable to existing hotels. That means an operator can be required to bring an existing hotel into compliance even without carrying out works.
Fire safety: reinforced requirements for sleeping accommodation
1 The general principle
Buildings open to the public with sleeping accommodation receive particular attention from the legislator: the occupants may be asleep when a fire starts, and therefore slower to react. That observation led to significantly reinforced requirements compared with an ordinary building of the same category.
2 The category A fire safety system
For any hotel with sleeping accommodation, including fifth-category establishments with bedrooms, a category A fire safety system is generally required. It is the most complete: it combines automatic fire detection covering the whole building with type 1 control equipment. The system allows early detection of a fire, automatic triggering of the evacuation alarm, and automatic safety operation of the installations — closing fire doors, starting the smoke control, stopping the ventilation.

3 Fire resistance and compartmentation
The construction separating sleeping accommodation from other rooms must have a fire resistance suited to the category. For the first four categories, floors are at least REI 60, rising to REI 120 for high-risk rooms; walls between bedrooms and escape corridors are EI 60; and bedroom doors are EI 30. Those doors are a crucial protection: in a fire they give occupants time to escape along the corridor to the stair.
4 Smoke control
Corridors serving sleeping accommodation must have smoke control. It may be natural, through façade openings operated manually or automatically, or mechanical, through dedicated ductwork. Enclosed stairs must also be smoke-controlled or held under pressure. For hotels in the first two categories, mechanical smoke control of the horizontal circulation is generally imposed.
5 Escape routes
The number and width of escape routes are calculated from the occupancy under the general articles. For sleeping accommodation the principal rule is that a protected stair must be reachable from any point of the circulation within 40 m, with dead ends limited to 10 m. Escape stairs must be distinct from private stairs and reachable from the corridors without passing through a high-risk room.
ℹ Frequent design traps A dead-end corridor exceeding 10 m with no escape route is non-compliant. Detection omitted from store rooms, luggage rooms or the linen room is insufficient. An EI 30 bedroom door without a self-closer is non-compliant: the door must close by itself. Control equipment without a 72-hour standby supply is non-compliant from the fifth category upward where there is sleeping accommodation. Detection installed but not connected to the control equipment is not a lawful installation.
Accessibility in hotels
1 General principles
As a building open to the public, a new hotel must be fully accessible to disabled people, whatever the disability — mobility, sight, hearing, cognitive. That obligation covers the common parts, the facilities and a proportion of the bedrooms.
2 Accessible bedrooms
The quota of accessible bedrooms is set by the accessibility order for new public buildings: at least one accessible room in any such building, or on request for adapted accommodation. In practice hotels above 50 rooms generally provide 2 to 5 % accessible rooms according to the level of service. An accessible room must allow a wheelchair to manoeuvre, with a 150 cm turning space beside the bed, include an accessible bathroom with a level-access shower tray, grab rail and folding shower seat, and carry adapted signalling such as a visual alarm for people with hearing loss.

3 Hotels in existing buildings
For a hotel refurbished within an existing building, derogations are allowed where there is a demonstrated technical impossibility — structural constraints, heritage conservation. They must be sought from the accessibility sub-commission when the planning application is filed, with a detailed technical justification.
The safety commission: mandatory visits
1 The opinion before opening
Every hotel in the first four categories must obtain a favourable opinion from the competent safety commission before opening to the public. That visit takes place after the works are finished and before the first guest arrives. The operator must request it at least a month before the intended opening. An unfavourable opinion prohibits opening.
2 Periodic visits
Hotels in the first three categories are visited every three years. Fourth-category hotels are visited every five years. Fifth-category hotels with sleeping accommodation are visited on request or at the administration's initiative, with no mandatory periodicity but with an opening visit recommended.
3 The opinion on the planning application
For hotels in the first four categories the safety commission must be consulted when the planning application is filed. Its opinion, which is advisory, addresses the scheme's compliance with the regulation. Where it is unfavourable the client may modify the scheme; the determining authority is not bound by the opinion but must give reasons for departing from it.
The environmental regulations applied to new hotels
The environmental regulations apply to the construction of new hotels under the accommodation use category, following the extension of scope beyond housing and standard commercial buildings. Hotels fall in the category of buildings of other use, covered by a specific order.
ℹ What to know Hotel use is treated separately from housing and offices in the calculation, with different occupancy scenarios and a high demand for domestic hot water. Heat pumps are favoured for hot water and heating, with an advantageous energy coefficient. The construction carbon indicator applies: reinforced concrete structures must justify their footprint through the life-cycle assessment. Large hotels above 1,000 m² of reference area carry the same certificate obligations at application and completion as other buildings. One notable exception: light leisure accommodation below 50 m² has followed a simplified regime since 1 January 2023.
Hotel star rating and regulation: how they interact
The hotel star rating, awarded by the national tourism body, is distinct from fire safety and accessibility regulation. There is no direct correlation between the number of stars and the regulatory category. A five-star palace can sit in the fourth category if its total occupancy is below 300, while a two-star hotel offering conferences can fall in the second.
Certain facilities required by the star rating — spa, indoor pool, conference room above 300 people — can, however, bring the establishment into additional regulatory types, each with its own requirements: covered pools and conference halls have their own regimes.
Planning: specific consents
Building a hotel requires standard planning permission with a public-building file: the safety statement, the accessibility certificate, the smoke control drawings. The determination period is five months, against three for other buildings, with a further month where the project sits in a heritage perimeter.
Converting an existing building into a hotel requires planning permission or, in some cases, a prior declaration according to the scale of the works. Moving from residential to hotel use is a change of use under the planning code, subject to permission or declaration according to the structural works involved.
The economic impact on the estimate
Estimating a new hotel or a hotel refurbishment must build in the regulatory premiums from the brief. These costs are often under-estimated in initial feasibility studies, notably the category A fire safety system and the accessibility adaptations.
